Well, it’s not entirely his choice. That’s just whether he wants to accept the judge’s ruling. Merck doesn’t have to accept it either way and can always appeal.

We’re still a ways from any money changing hands. Which kind of illustrates the folly of forming opinions based on large verdicts alone. There’s a LOT that has to happen before the case is over.
