This whole situation is so utterly ridiculous it makes me ashamed. Florida needs to be submerged and cleansed of its sins. In my book Florida has replaced California as the most Whacko state. No wonder everyone from Rush to O.J. lives there. Count me out permanently.

Yes, there are pieces of this story missing. If there is a settlement offer the attorneys have to make that known to their clients. They then HAVE to follow directions from their clients. Either the Drs. are lying and THEY refused the settlement offer believing they would not lose the case or those Attorneys will be out of jobs.

Failure to communicate a settlement offer (i.e., to reject it without clear authority beforehand) is a grievous ethics violation punishable by disbarment.

Somebody (i.e., either the lawyers or the clients) is telling a mighty big fib here. Mighty big.

I am hoping that this will be more of trend. Here in Tennessee, the courts have upheld that a statewide standard of legal practice exists. This was a milestone for us as it opens up attorneys to further legal malpractice litigation. One of the hard parts has been finding attorneys who will sue other attorneys. Luckily, a large firm from Atlanta has now jumped on the opportunity. I hope it gets to the point that the attorneys are the ones who want caps!
