If there is a settlement offer the attorneys have to make that known to their clients. They then HAVE to follow directions from their clients. Either the Drs. are lying and THEY refused the settlement offer believing they would not lose the case or those Attorneys will be out of jobs. Yes, there are pieces of this story missing. Here in Tennessee, the courts have upheld that a statewide standard of legal practice exists. This was a milestone for us as it opens up attorneys to further legal malpractice litigation. One of the hard parts has been finding attorneys who will sue other attorneys. Luckily, a large firm from Atlanta has now jumped on the opportunity. I hope it gets to the point that the attorneys are the ones who want caps! I am hoping that this will be more of trend.
