Not "fair?" Perhaps you can tell us what's "fair" about ALL physicians, even those who've never been sued, being forced to pay exhorbitant malpractice premiums to cover the defense costs of the 70% of cases which shouldn't have been filed in the first place?

Or what's "fair" about being named in a lawsuit for a patient you've never even seen?

Or what's fair about patients not being able to find medical care because the doctors who WOULD have been available take care of them have fled to states WITH reasonable liability reforms?

To paraphrase Mae West, "Fair ain't got nuthin' to do with it...."

The fee is paid by EVERY lawyer in the state, whether they represent patients or doctors in court, or whether they practice in a completely unrelated area. Not exactly fair!

I have a friend that is a medical malpractice lawyer. He is a drunk and works 6 months out of the year. By the way last year he made over $4 million!

It should be a $7,500 yearly fee. After all, lawyers are rich, right? And they can just consider it a part of doing business.

Why the hell would they know there is a malpractice crisis? They never set foot in our ERs. It’s like when we act like we know what goes on in cort. They have no idea the crisis that has been caused by having to over-test every patient that comes through the doors.
