That should put a damper on provision of contraception by physicians in Germany.
“The device is meant to protect against pregnancy for up to three years, but half a year after the operation, the implant could no longer be found in the woman’s body, the court said.”
Since these things are place under local anesthesia (I’ve even done these myself) and the patient witnessed the procedure it does make one wonder how the implant went missing. Since the patient was in custody of the device after leaving the office could she have been involved in its removal either deliberatly or by accident. Either way she is not going to tell her boyfriend (trapped by an unplanned pregnancy is a very old dating ritual) and look to blame others.

This is hilarious in a world where so many couples are praying every night that they could have children. Perhaps the court could give the OB-GYN 50% custody of the child.

Every method has a success rate, and conversely a failure rate. How is this considered outside the standards for contraceptive use?

Is falling out considered part of failure rate? I was under the impression that if it is there but fails to prevent pregnancy, that would be a failure rate… They must have claimed it wasn’t placed properly or something (question to doctors: is it possible, likely? Or is gasman’s scenario on trying to trap a boyfriend far more plausible?)
At any rate, being childless I find it very hard to find any sympathy for anybody who complains on having a healthy baby. She could’ve given it away, or even had an abortion.

I read the article and it sounds like she had some sort of implant like implanon or norplant. These do not fall out, they have to be removed. If the implant worked it’s way out of the skin the patient probably would have noted redness and pain at the site.
IUD’s can fall out, even when they have been properly placed.

This is absurd for so many reasons. But what gets me is this: Doesn’t this sort of suggest that the child *remains* unwanted? If she wants to keep the child, how in the world is this judgment justified? If she didn’t want the child, why didn’t she give it up for adoption? I’m sure there are plenty of people who would have gladly taken this “burden” on themselves. How is it that she gets to keep the child but push the costs of raising it on someone else?
Are there other ramifications? What about people that get pregnant while taking birth control pills? Should the prescribing doctors be required to pay child support? What about couples on the “pull out” method? Should the man foot 100% of the bill for the child’s upbringing if the mother didn’t “want” it (but “wants” it enough to keep it)?
