Patients get medical care that they clearly need (500 people on the waiting list), but lose the opportunity to sue the doctor. If he doesn't volunteer, then they don't get medical care, and they still can't sue about it. It's the Prisoner's Dilemma - simple game theory - either way, you can't sue the doctor, so you might as well go with the way that will get you medical care.
