A Massachusetts jury hands out the largest malpractice judgement in state history
“The family of a Dracut 8-year-old with severe brain damage resulting from an alleged botched birth delivery was awarded nearly $40 million yesterday in what’s believed to be the largest medical malpractice judgment in Massachusetts history.”

The 40 million award figure mentioned in your excerpt includes 8 years of interest on the verdict for damages
The jury awarded 23 million in damages.

Also, the full verdict won’t be paid – it’s capped by a high-low agreement made between the parties before the verdict was returned.

I know the lawyer who lost. He was not known for his expertise at trial.
