Arizona signs some common-sense malpractice reforms
"The new law says expert witnesses in these cases must practice in the same area as the physician being sued. And if the defendant is 'board certified' in a specialty, the witnesses also must be certified by the same board . . .
. . . Napolitano had no problem with another part of the legislation, which will permit a doctor to apologize for a mistake without having that statement used in court."

It's amazing that they had to pass a law that says something so obvious. Several years ago I (an ophthalmologist) was sued and the expert witness against me was a family doctor who, since he worked in an ER, claimed to extensive knowledge regarding the diagnosis and treatment of retinal detachments.
The judge told the plaintiff's attorney to get a real expert, and they could not since the case had no merit. But, not before much wasted time and money that obviously could have been spent far more productively. Hopefully the Arizona law will prevent such needless waste, which the citizens of the state wind up paying for.
