Now this is the kind of legislation I like. Not only does it institute caps for businesses that range beyond medical institutions/practices, it also has rules to reform the court proceeding processes (although the article doesn’t flesh those out, unfortunately). Caps are very nice, but I always felt they’re only part of the solution.
And, for the patients’ rights advocates, any doctor with three or more malpractice claims against them gets investigated. That ought to silence a lot of the med-mal horror stories about cases where a practitioner gets a slew of complaints against them.
Unfortunately, this bil passed by a very thin margin. Med-mal legislation has failed before with more support in other states, so I’m simultaneously hopeful and cynical about its prospects.

Nate, how can you continue to support caps when there is no evidence at all that they work?
States with caps have increases in premiums just like those that don’t. And the insurers themselves say caps have little to do with their losses. Do you not believe them?
How does not allowing a jury to hear your particular situation and make a determination as to your damages help you?
